The Practice introduced the client to a project, for which we subsequently established a Foreign Investment Company, with the necessary licenses and permits, to allow the client to participate in the open Tender process.

We worked closely with the Founder Shareholders to create the most suitable offshore vehicle for a Group of investors and the project financier. We assumed an advisory role during a lengthy and successful tendering process, during which we were integrally involved in the preparation and submission of the tender documents. We carried out financial modelling for the purpose of borrowing and to build investor interest.

Advisory work was undertaken relating to the formation of a Consortium; liaison between the Consortium Members with due consideration to the underlying investment needs and the participation obligations of all the respective parties; preparation for a future Public Listing; assistance with senior recruitment; we worked with International Lawyers to provide legal and commercial advice.
